Frank Buttimer, solicitor, said there was nothing sinister about the actions of Mariusz Jakubowicz, aged 39, on September 19 at Highbury, Carrigaline, Co Cork, but he could understand that the defendant’s ex-wife became concerned.

The defendant’s wife had a protection order and contacted Garda James Landers as soon as she got the call from her ex-husband when she was at work on the day.

Garda Landers was told by the woman that her ex-husband had phoned to say he had broken in by a side window and there was a trail of blood through the house.

The defendant told her on the call he had only broken into the house to see the dog.

Inspector Adrian Gamble said from that point on the defendant contacted gardaí and co-operated fully.

Mr Buttimer said, “This man has never been in trouble...

He did not intend it to be sinister, she contacts the guards and they rightly consider it is a breach of the protection order. He realises the relationship is at an end. He is otherwise inoffensive.”

Judge Marie Keane fined him €150 and said: “You must obey the protection order.”
