€12k for whiplash injuries in collision

Patrick Nedum told the court that, on September 27, 2011, he was stopped at traffic lights on Eden Quay, Dublin, during rush hour when Ms Canavan rear-ended the car behind him, driven by Bernie Keenan, which then bumped into his car.

Mr Nedum, of Sherrad St, Dublin, claimed the impact was a “big bang” which pushed his car boot in. He said he developed neck pain the next day. He told his barrister, Robert Fitzpatrick, that he suffered neck pain for a year and had difficulty sleeping, lifting, and carrying. The court heard he had needed to take anti-inflammatories and painkillers.

Mr Nedum sued Ms Canavan, of Castleknock Cottages, Castleknock Rd, Castleknock, Dublin, and Ms Keenan, of Elderwood Rd, Palmerstown, Dublin, for negligence.

Ms Canavan told the court the impact was minor and caused no damage to her car. Ms Keenan said she suffered no injuries. Both alleged Mr Nedum had suffered neck injuries in a an accident in 2008. They also claimed his neck injury was the result of a degenerative condition.

Mr Justice Raymond Groarke said he was satisfied that Mr Nedum had suffered whiplash-type injuries. He awarded him €12,600 damages, along with legal costs.
